Terms of Service
1. Agreement to Terms
By accessing or using Resume Optimizer ("the Service"), operated by the owner of myresumeoptimizer.com ("we", "us", "our") at myresumeoptimizer.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
Resume Optimizer is an AI-powered tool that helps job seekers tailor their resumes to specific job descriptions. The Service analyses your resume and job description, identifies gaps, generates suggested resume bullets, produces a tailored resume draft, and optionally generates a matching cover letter. Output is generated using large language model AI provided by Anthropic, PBC.
3. Eligibility
You must be at least 18 years old to use this Service. By using the Service, you represent that you are 18 or older. This Service is not intended for use by children under 13 (see our Privacy Policy).
4. Accounts
You must create an account to use the Service. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Providing accurate and up-to-date information.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Service.
5. Acceptable Use
You agree not to:
- Use the Service to create false, misleading, or fraudulent resumes that misrepresent your qualifications.
- Reverse engineer, scrape, or attempt to extract our prompts, algorithms, or underlying systems.
- Use automated tools to access the Service in bulk or in ways that place unreasonable load on our infrastructure.
- Resell, sublicense, or commercially redistribute outputs of the Service without our written consent.
- Upload content that is unlawful, defamatory, or infringes third-party intellectual property rights.
- Attempt to circumvent plan limits or credit systems.
6. AI-Generated Content — Important Disclaimer
The Service uses artificial intelligence to generate resume content, bullet points, cover letters, and analysis. You acknowledge and agree that:
- AI-generated content may contain errors, inaccuracies, or information that does not accurately reflect your experience.
- You are solely responsible for reviewing all AI-generated content before using it in any job application.
- We make no guarantee that use of the Service will result in job interviews, offers, or any particular employment outcome.
- ATS scores and gap analyses are estimates based on AI interpretation and are not guaranteed to reflect the scoring methodology of any specific employer or applicant tracking system.
- You should not submit any AI-generated content without reading it carefully and verifying its accuracy.
7. Intellectual Property
Your content
You retain full ownership of your resume content, job descriptions, and any other materials you upload to the Service. By uploading content, you grant us a limited licence to process it solely for the purpose of providing the Service to you.
Our content
The Service, including its design, code, branding, and methodology, is owned by us. You may not copy, reproduce, or create derivative works from any part of the Service.
AI-generated outputs
Resume drafts, bullet points, and cover letters generated by the Service are provided to you for your personal use in job applications. We do not claim ownership of outputs generated specifically from your content.
8. Plans, Credits, and Billing
Free tier
New users receive a limited number of free applications as stated on the pricing page. Free tier limits are per account and non-transferable.
Paid plans
Starter and Pro plans are billed monthly via Stripe. Plan features, pricing, and limits are as described on the pricing page at the time of purchase.
Credits
Each full application (resume analysis through to draft generation) consumes one credit. Cover letter generation consumes one additional credit. Credits are non-refundable and do not roll over between billing periods unless otherwise stated.
Cancellation
You may cancel your subscription at any time via the Account page. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing period.
Refunds
We offer refunds at our discretion within 7 days of a charge if you have not used the Service in that billing period. Contact us at hello@myresumeoptimizer.com to request a refund.
9. Availability and Service Changes
We aim to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, change plan pricing or features with reasonable notice, and perform maintenance that may temporarily interrupt access. Where possible, we will provide advance notice of material changes.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim. Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence.
11. Indemnification
You agree to indemnify and hold harmless the owner of Resume Optimizer from any claims, damages, or costs (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of California, USA. Any disputes shall be resolved in the courts of San Bernardino County, California, or through binding arbitration at our election. If you are located in the UK or EU, nothing in these Terms affects your statutory rights under applicable consumer protection law.
13. GDPR and CCPA
Our data practices are described in full in our Privacy Policy. For users in the EU/UK, we process your data on the legal basis of contract performance and legitimate interests. For California residents, see the CCPA section of our Privacy Policy.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
